Atech Autos does not make any representation or warranty and expressly disclaims any and all such warranties and terms in respect of any products, services, information or materials. Depending upon the specification, purchasing a vehicle may involve a time delay between ordering the vehicle and taking delivery.
The development of Atech Autos products and services is continuous and published information may not be up to date. It is important to check the current position with Atech Autos. Atech Autos may at any time and from time to time without prior notice to you discontinue the website either permanently or temporarily or change any of these terms and conditions without affecting any accrued rights or liabilities.
Atech Autos shall not be liable for any claims or losses of any nature, arising indirectly or directly from use of the data or material on this site, unauthorized access to this site, the accuracy, timeliness or completeness of the contents of the website or otherwise howsoever arising (except liability for personal injury or death arising from negligence or to the extent required by law). You agree to indemnify Atech Autos for any loss or damage suffered by Atech Autos arising out of your use of this website and/or your breach of the terms and conditions of use.
Prices and vehicle details including mileage may differ from that shown. As the vehicles shown are used vehicles the specification may not be as standard. Additional mileage may be incurred due to use of vehicles for demonstration purposes. Offers, prices and vehicle details may be subject to change. Please ensure that a vehicle has any specific feature that is important to you prior to purchase. Crew members at our stores will be happy to assist you.
METHOD OF PAYMENT
Purchaser shall pay the Purchase Price in cleared funds by bank transfer. Credit and debit card payments are not acceptable unless specifically agreed in writing signed by an authorized representative of the Seller and may incur additional charges.
The Seller accepts payment by cheque only if the Seller receives the cheque at least five (5) clear banking days before the date on which delivery of the Vehicle is intended to take place. Payment shall not be deemed to have been made until cleared funds are received at the Seller’s bank.
An agreement to accept payment on credit terms shall be effective only if in writing and signed by an authorized representative of the Seller. Any agreed credit period shall commence from date of delivery of the Vehicle and unless otherwise specified shall be seven (7) days.
The Seller reserves the right at any time prior to payment to request banker’s or any other references as to the Purchaser’s financial status. Failing receipt of satisfactory references the Seller may withdraw any agreement to receive payment otherwise than in cash on delivery.
Interest will be charged to the Purchaser on all amounts remaining outstanding and unpaid after the due date for payment and/or on all sums due by way of damages for breach of the Contract at the rate of 20% per annum above the base rate of Access Bank PLC from time to time in force and shall be calculated and accrue on a day to day basis from the date on which payment fell due until payment in full has been received by the Seller (whether made before or after judgement has been obtained). If no specific date for payment is set out in the Contract and credit terms have not been agreed the due date for payment shall be deemed to be the earlier of:-
a) the date of delivery of the Vehicle; and,
b) the date which is ten (10) days after notice from the Seller to the Purchaser that the Vehicle is ready for delivery.
Normally, amounts received from the Purchaser shall be applied in payment of the oldest debt but the Seller may at any time in its absolute discretion appropriate any payment it receives to such outstanding debt as the Seller thinks fit, notwithstanding any purported appropriation to the contrary by the Purchaser.
